Specifications appended to the final license for the establishment and operation of a terrestrial mobile telephone network DUAL-BAND GSM 900/1800 Mhz
 
CHAPTER I: DEFINITIONS
The terms below beginning with a capital letter have the following meaning:
 
Subscriber (s) to the Service or Subscriber (s): indicates and means Customer (s) included in the initial location register of the Operator;
 
Interconnection Agreement: indicates and means the contract between the Operator and any other telecommunications network Operator open to the public, defining the conditions for interoperability of their respective networks;
 
Shareholder: indicates and means the natural or artificial person majority shareholder to the capital of the Operator at the time of issuance of the license to manufacture;
 
Administration: indicates and means any State structure other than the ATCI. Telecommunications Agency of Cote d'Ivoire, ATCI or Agency: indicates and means the public corporation established by Decree No. 98-506 of September 16, 1998; which exercises the powers, duties and obligations vested in the administration by the Telecommunications Code;
 
Schedule: indicates one or more appendixes herein which form part of the Specifications .
 
Certificate of license: indicates and means the document entitled "Certification of license" issued on a provisional basis in 1996 by the ATCI to each of the three companies for the establishment and operation of a terrestrial mobile radio communications in the band of 900 Mhz.
 
Authority or public authority: means any State structure in charge of national defense, security and civil defense.
 
Specifications: means this document, including its Annexes;
 

Customer: means service Subscribers and mobile users; Telecommunications Code or Code: means Law No. 95-526 of July 07, 1995 bearing Code of Telecommunications, including amendment texts;
 
Cote d'Ivoire Telecom: means the long-time public fixed network telecommunications career;
 
International Telecommunication Convention: means the Convention of the International Telecommunication Union (ITU), one of three instruments of the ITU which Cote dfIvoire is a signatory.
 
C.C.T.P. : means the Special Conditions of Contract enclosed as appendix 1 to this document, detailing specific issues related to the establishment and operation of GSM 900 / 1800 Mhz and will be updated at least once a year;
 
Date of issuance of the Certificate of License: means the date on which the certificate license has been issued for the first time.
 
EDGE (Enhance Data Rate for GSM Evolution): means a new GSM modulation which increases the flow of data.
Essential requirements: Refers to and means the necessary requirements to ensure in the public interest, the safety of users and staff operating telecommunications networks;
 
Operator: means and refers to:
The Company holder of the GSM operating license;
 
National Telecommunications Fund (FNT): refers to and means the fund established by Decree No. 98-625 of November 11, 1998 in the Autonomous Amortization Fund
 
 
Force Majeure: refers to and means any irresistible, unforeseeable event and external to the will of the parties, including radioactive or chemical contamination, acts of terrorism, riots, wars, earthquakes, fire, explosions, tornadoes, floods, expropriation, etcc provided they meet the conditions listed above.
 
GPRS (Global Packet Radio Service): refers to and means the switching data system by packet to improve the flow rates provided by the GSM
 
 
GSM: refers to and means the public digital radio service in the band 900 / 1800 Mhz, as defined by ETSI;
 
Agreement: Means and refers to the process that allows the ATCI to assess the compliance of wireless mobile device and other network equipment to the requirements defined by the ITU. These requirements are primarily intended to ensure that equipment does not harm the network, the users of wireless mobile device and other equipment.
 
License to manufacture or permanent license or License: refers to and means the document issued by the ATCI to Operators, testifying the authorization to establish and operate a terrestrial mobile radio communications in the GSM standard, for a period of twenty (20) years;
 
Authorized Operator or Operator: refers to and means a network Operator and / or awarded service (s) telecommunications of a concession of exclusive rights of the State, by decree of the Cabinet or authorized to provide telecommunications services under an authorization or a declaration in accordance with the law.
 
Party (ies): refers to and means ATCI or Operators, either or both;
 
ITU-T: means and refers to the Sector of Telecommunication Standardization of the International Telecommunication Union;
 
Mobile users: refers to and means Customers, Subscribers traveling and using a different network than their own;
 
Service: refers to and means the radio service as defined in paragraph 3.1 of this Specification;
 
Fixed telephone service: refers to and means the service offered by telephone between fixed terminals, unlike the mobile phone service offering that service to wireless mobile device;
 
Texts in force: refers to and means all laws, regulations and Ivorian and international standards in force on the date of signature of this Specification, including the standards set or referred to in this Specification and the texts listed in Annex 5.
